Hace pocas semanas 50 madres comunitarias ante el desespero de ver la burla a sus derechos laborales por parte del Estado colombiano, se tomaron la Catedral Primada en Bogotá, donde realizaron una huelga de hambre.

En comunicado explicaron que vienen laborando durante más de 30 años bajo la subordinación del Instituto Colombiano de Bienestar Familiar, ICBF, atendiendo la niñez de escasos recursos en todo el territorio nacional, sin que les sean reconocidos sus derechos y sufriendo una clara violencia estatal en menoscabo de sus derechos fundamentales.

Por lo anterior, la Corte Constitucional había dictado la sentencia T-480 de 2016, donde reconoció todos los derechos laborales, prestacionales y pensionales de las madres comunitarias y su verdadera relación laboral con el Estado colombiano. “Sin embargo, en un acto más político que jurídico, la misma Corte Constitucional cambió de parecer ante el incidente de nulidad presentado por el Gobierno, emitiendo el Auto 186 de 2017, donde solo se le reconocían los derechos pensionales”.

Según directivos del Sindicato Nacional de Trabajadores al Cuidado de la Infancia y Adolecentes del Sistema Nacional de Bienestar Familiar, Sintracihobi, hoy la lucha de las madres comunitarias continúa, pues con verdaderos malabares de lógica jurídica la Honorable Corte Constitucional sigue cambiando sus tesis de derecho hacia las conveniencias políticas del Estado, con lo cual ven peligrar incluso sus derechos pensionales.

A pesar de los acuerdos internacionales de derechos humanos ratificados por el Gobierno en relación al reconocimiento del carácter fundamental de los derechos laborales y la primacía de la realidad por encima de las formalidades, el Gobierno nacional es quien más conculca tales derechos a través del uso de artimañas jurídicas para encubrir la verdadera relación laboral de millones de funcionarios públicos a quienes les aplican órdenes de prestación de servicios, OPS, intermediación ilegal, contrato de servicios especializados y demás.

Pensión imposible

Por su parte, la Central Unitaria de Trabajadores, CUT, se pronunció diciendo que la sentencia de la Corte es un desconocimiento a sus derechos y que como consecuencia ellas deberán pagar el 20% de sus aportes para acceder a una pensión.

“Bajo esta interpretación, el máximo órgano constitucional definió que las personas que se encuentran suscritas al programa de Subsidio al Aporte de Pensión deberán pagar sus aportes correspondientes. Son más de 20 mil mujeres que salen sin ningún reconocimiento, proclives a la indigencia y a depender de sus familias, después de haber laborado por más de 32 años en el ICBF, al programa del cuidado de la infancia, que al convertirse ahora en un trabajo considerado voluntario, les impedirá pensionarse”, explica la CUT.

Ante el abandono, las madres comunitarias organizadas en Sintracihobi anunciaron acciones legales en el ámbito internacional.
